Ethics

eMagic only engages in ethical SEO practices and techniques. The long-term stability of our client’s websites ranking is the top priority for eMagic, beyond any short-term results that unethical techniques could produce.

Indemnity

SEO is a best effort service and there are many factors beyond eMagic’s control that can impact your search engine performance. eMagic shall not be liable whether in tort (including for negligence or breach of statutory duty), contract, misrepresentation, restitution or otherwise for any loss of profits, loss of business, depletion of goodwill and/or similar losses or loss or corruption of data or information, or pure economic loss should Your website suffer a loss, downward movement or removal of its search engine rankings.

Maximum Extent of Liability

eMagic’s total aggregate liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the services provided by it under this agreement during the 30 days preceding the date on which the claim arose.

Termination

Once a Search Engine Optimisation service has commenced, the service becomes non-refundable. A large investment has been taken on by eMagic to improve your website’s search engine rankings in the fastest possible time, which cannot be recovered once it is incurred. If you wish to cancel your service we require 30 days’ notice in writing to be submitted to accounts@emagic.co.nz.

Payment

• All charges payable by You for Services shall be in accordance with the scale of charges, rates and payment quoted by us and shall be due and payable according to the terms within our quote.
• Without prejudice to our other rights and remedies under these Terms and Conditions, if any sum payable is not paid on or before the due date, We shall be entitled forthwith to suspend or cancel the provision of Services to you.
• If You fail to pay any sums due to us as they fall due, We may suspend or cancel any Services without notice to you. Accounts are typically suspended seven days after the due date and fully cancelled after a further twenty-one days.
• Any cost incurred in the collection of overdue accounts is payable by You.

Guarantee

The 90-day ranking guarantee begins from the day we receive all the access to your site as needed and is void if our changes are overwritten or lost by the work done by your company.
